We handle collection actions for businesses. These are not actually “debt collections”- they are legal steps and procedures taken pursuant to a breach of a written or verbal agreement to pay a sum certain for a product or service (or failure to repay a loan).

When customers and clients who don’t pay bills are a problem, sometimes it takes an aggressive approach to let them know you are serious about being paid. Other times, it is a sensitive topic that requires tact and care, so that relationships are not disturbed and more business can be done in the future.

We handle these on a contingent fee basis (20% of amount collected). We’ll review the basis for the payment owed and develop the theory of the breach of payment and the proper approach to collect monies due.

We use best efforts to resolve outstanding receivables without litigation. Filing of lawsuits, when necessary, are on an hourly fee basis.

When we form businesses and make investments, we only see the good side and hope for positive outcomes. Receivable Advance™

Our investor clients will purchase receivables/invoices that meet the following criteria:

​- Open invoice is for a service provided in New York or a product delivered to a New York resident

– Business Debt: If the receivable is due from a business (i.e. a product or service provided to a corporation or LLC for a business purpose), the company/debtor that owes the money must be in business for over 5 years

– Consumer Debt: If the receivable is due from a consumer (i.e. a service or product sold to an individual for household or personal use …. ex: home repairs, medical services), the person responsible to pay the bill or invoice (the receivable) must live outside New York City

Terms:
– Face value of receivable: $300.00-$4,000.00 *

– Receivable is less than 120 days past due

– Proof of the service provided or of the product delivered by your company that led to the invoice or bill is required

– Will pay approximately 50% of face value (final amount depends on circumstances, invoice age, and the payor/debtor profile)
– Approximately 10% is paid back to the debt seller upon full collection (less collection costs). Specific terms and conditions to be provided at time of purchase

* Will purchase a receivable in any amount, but will pay a maximum of $2,000.00 for any receivable.

Will not purchase receivables for construction/contracting work

​Businesses with receivables for sale may be located anywhere in the U.S. provided that the payor/debtor is in New York State.

Rent Advance™

We will buy up to 3 months of future rent obligations due from your residential tenant at approximately 70% of amounts due (the final purchase price depends on length of tenancy, tenant profile, payment history). Judgments: We will consider buying judgments on a case by case basis following an evaluation of the circumstances and of the judgment debtor.

Debt Settlement: How Bad Does Your Debt Need To Get?

To use debt settlement or debt management services, you need to be in default, and in significant default, to get debt help; and even then, you can read online how effective (or ineffective) these programs are. Debt settlement companies need leverage- in the form of your financial pain- to negotiate with credit card companies on your behalf.

Debt Solutions from The Siskind Law Firm wants to help you as soon as you are behind- or before you get behind on obligations. I don’t want you to ever get into significant default.

Debt settlement programs are generic programs managed by people with no financial or legal backgrounds who are hired to send letters to credit card companies saying that you can’t pay. These companies do not or should not be handling real negotiations- such as with lenders, landlords, hospitals, or any other creditors. For that, you should use an experienced business attorney (or a CPA).

Unless you are planning and qualify to file for bankruptcy, settling debts faster is better than defaulting further, on purpose. Either way, you have to make payments on the debt at settled amounts at some point. Plus with legal help, you may find that a debt is invalid or proper procedures have not been followed by creditors.

Debt settlement programs are only for credit card debt, in my opinion, and they’re only if you don’t plan to file bankruptcy. In all other cases, if you don’t plan to file or qualify for bankruptcy, you need a professional negotiator and a professional approach to debt- not a way to dig yourself deeper into it.

Business Receivables: The Longer You’re Owed Money, The Less Likely You Are To Get It- By NEIL S. SISKIND

It can sometimes feel like giving someone more time to pay invoices, debts, or recievables, will offer them a better likelihood of accumulating the funds and paying the monies due.

Probably not true.

The more time you wait for your money, the more likely that it’s going to another creditor, or that your debtor goes out of business or files for bankruptcy, or that the lack of discipline your putting on your debtor is causing that debtor to put you off, because he or she can.

The more a debt ages, the less likely you are to get paid. Meanwhile, you may, in turn, owe money to someone on which interest, and ill-will and reputational damage, accumulates.

When you let receivables continue to accumulate or grow, it’s your own lack of discipline and good stewardship that is to blame for hits to cash flow and margins. You’re trying to be nice to the customer or client, perhaps, but you’re not being nice to your company, or to your employees, or to your vendors, or to your lenders, or to your credit. You’re putting everything at risk.

Finally, after time, there is no other way other than through aggressiveness and a lawsuit to try to get paid. And then you’ve gained nothing, and lost plenty- including any profit margin on the transaction, and any remnants of the relationship with the debtor.

If your owed money- get paid. There are proper ways to handle it based on the particular circumstances, and with the proper help.
