Perspective

I read the comments on Yelp that people write about businesses in their own towns and neighborhoods, and I wonder to myself: What has happened in this country to “Love Thy Neighbor”?; what has happened to “I’m My Brother’s Keeper”?; what has happened to the value of community?; what has happened to “What Would Jesus do?”?; what has happened to people caring that others in their communities can put food on their children’s tables?; Instead…anger…vitriol….vengeance….insults. And this is why storefronts are empty and customer service comes from India, and jobs at the lower end are gone. Who suffers from these business reviews?; business owners, business employees, children of employees losing jobs; and you- you who writes these comments, you lose a local job and a local place to shop, and a business that cares to know your name. You all play into the hands of Internet companies who use your comments to sell advertising around- that is what they care about- they are not there to hear-out your hurt feelings- they are there to use your content to sell advertising- and then send your ad sales, computer programming, and customer service jobs to other lands. So you lose your local job because of all your rude comments, and then you lose the job outsourced by Internet companies who asked you to post your rude comments for their profits. You lose twice. When you seek to lash out at and hurt a company- in the long run you hurt yourselves as much.

A Filthy Row – A Poem

A Filthy Row

Pretty Lady, hopeful heart,
royal bloodline, noble start,
dreamed of palace for the part-
a prince on horseback- there thou art!

He asked for marriage, Prince of Wales,
he offered Lady fairy tales
and palaces and ships he sailed-
his father now he had not failed.

And love would blossom through the land,
pictures placed on each newsstand,
two children followed wedding band-
the Bachelor Prince, now family man.

Their hearts grew fonder, ‘til they stopped,
love to hate, it finally got;
he loved another, and Lady’s lot
to be his queen would happen not.

Prince and Princess broke their vows,
it led up to a filthy row,
’twas all the mess Queen would allow,
they would divorce, and end it- now!

The Prince and Princess went their ways
in a fireball of public craze,
she turned her heart towards better days,
he ventured to Camilla’s gaze.

Next to happen, as we’d seen,
the Lady was the global queen,
purpose, love, and in between-
our Lady Di was so pristine.

The Lady, she found love again,
and put behind her prior pain,
she found her purpose for her name-
alas, it was to be in vain.

And on that final hurried ride,
cameras chasing every side,
worldwide hearts together cried,
when Lady, queen, and mother died.

The story’s moral to impress,
when public interest will obsess
on family matters, more or less-
a filthy row turns filthy mess.

Attacks On Lawyers

I’ve noticed over the years, and after speaking to my associates, that the people who accuse their lawyer of only being after their money are almost always people who don’t have any to have been after. It’s just their rage and frustration with their lives. Everyone in this world is responsible for their own success…..and their own failure.

I May Be On The Truman Show!; And We All Soon May Become Actors, Guest Stars, and Extras, Like It Or Not

The 1998 film, The Truman Show, starring Jim Carey and Ed Harris, is a story about a man named Truman Burbank, whose entire life, unbeknownst to him, was being filmed and broadcast to televisions and homes across the world, live, in real time.

Prescient?

Companies like Periscope, Snapchat, and Facebook are betting that user-generated live-video broadcasts of common events in people’s lives will be a cornerstone of entertainment and communication in the future. Facebook Live, with its live-video broadcasts over Facebook (including of rapes and murders and suicides) is the focal point of Facebook’s live-video entertainment and communications strategy.

The explosion in popularity of live sports television, combined with DVRs allowing viewers to skip past commercials and Snapchat’s launch, have provided the impetuses for many companies’ respective investments in user-generated, live-video entertainment, where viewers, ideally, will watch each other’s broadcasts in real time in order to get the full effect and complete entertainment value, while, theoretically, providing advertisers with a better vehicle for grabbing viewer eyeballs.

It remains to be seen what advertising model will work in connection with user-generated live- video content.

Filming “real life” events as they unfold, as a regular form of entertainment, originated (aside from sports and the evening news) with the program Cops, on which any of us who made an illegal U-Turn while driving a rental car late at night in Fort Lauderdale during a Christmas vacation could have ended-up a guest star. Cops wasn’t broadcast “live”, but it seems a pre-cursor to what companies such as Facebook and Periscope are seeking to do in making every-day-life events into video entertainment for mass-market consumption, while making everyday people into the entertainers.

Live video A

Actually, the pioneer of live broadcasts of live, “non-scripted” events over the Internet is the pornography industry with its live webcams where viewers pay to be voyeurs into the (very) private aspects of a person’s life and where the paying viewers can even direct the….umm…..let’s say, “subject”….. to engage in actions, thus providing real time interactions, an important element of companies’ live-video strategies.

Live video broadcasts are different than reality TV in that there are no themes, no person or people who are the focal points, no storylines, no corporate or network production, editing or marketing, no hosts, and they have the potential for appearances by people without their consent. Spontaneous life events are the stars, as opposed to any particular widely-known or followed character(s). Live-video is about whose life you want to enter at any particular moment. Though people, just as with YouTube, can, and surely will, craft their own brands and establish fan bases within the platform by regularly live-broadcasting their (allegedly) unplanned events and interactions and communicating with viewers during them.

Between the live and interactive broadcasts by porn companies, Cops’ broadcasting of spontaneous, real life events for mass market entertainment, YouTube’s use of user-generated videos, Facebook’s complete knock-offs of Snapchat through Instagram, and Facebook’s history with the Winklevoss brothers, Facebook has hardly ever had an original idea of its own. So, live-video is Facebook’s hope that we will be the creators of new and original ideas (and bad behaviors) that keep eyeballs glued to its website.

As the user-generated, live-content entertainment model expands, the paying of professional actors for their work in entertainment productions may become less prevalent. “We” will be the actors. “We” will be the TV stars. We will be the “Trumans”….if we so choose; or, we will be part of supporting casts in other people’s live broadcasts at our schools, in our supermarkets, out at restaurants, at our Starbucks, in our gym locker rooms, and everywhere else……even if we don’t so choose!

So, prepare yourself for a future that will be filled with “real-life Truman Shows”, where we all may be unsuspecting guest stars on live broadcast at any given moment……even if we don’t have agents…..and even if we haven’t had our hair and make-up done before the scene is shot.

Just as small brick and mortar retailers have found it nearly impossible to compete with national retailers that sell products in the same categories, online retailers who fail to have unique and desired products will not be able to compete with large online retailers; not only Amazon, but other large and well-financed retailers, who can manufacture and buy product with scale and who can offer better shipping terms and higher levels of customer service.

The Internet was once an equalizer where small businesses could compete with larger retailers, especially in cases where small retailers strictly sold through the Internet where the competition had brick and mortar stores. But, as all retailers become online retailers, and as corporations and venture capitalists finance new online retailers in ways that allow such retailers to instantly become category killers, the small business retailer online, just like offline, will become unable to compete- unless they have the most unique patented products or some very special and difficult to replicate product or concept.

The Internet is actually turning out to be a big disadvantage for small business. While, once upon a time, a company could launch quickly by using a website, as the Internet grows, any advantage, such as relationships or being geographically convenient, are irrelevant, and everyone will compete on price and service- and consumers will always pick what costs less and gives more product and service for the money. Plus, online reviews are nearly irrelevant to large companies. Small businesses suffer far more from negative feedback than big businesses.

Hardest Part of Being an Attorney

The hardest part about being an attorney or business consultant is that you often find yourself dealing with intelligent and sophisticated matters with unintelligent and unsophisticated people. As a lawyer, you not only help people with business transactions, but you are, actually, yourself, entering into business transactions with the clients, who often have no experience with how a business transaction works. This is why (except for pro bono or charitable purposes) I’ve stopped accepting clients who are without significant business and financial experience. It’s just not worth it at this stage. There is little professional gratification when working with people who are not on my professional level. Unfortunately for many businesses, they have to deal with people of all levels; for example hotel owners have no choice but to hear input and feedback from people who never operated or owned a hotel ever in their lives, and who never could reach such an achievement, yet fancy themselves qualified to go online and critique every hotel owner and every hotel they stay in. They have no understanding of what goes on behind the scenes to keep a hotel or business operating every day, which is why they do not own them- they only criticize them. It’s ridiculous. Fortunately, I do have a choice about which customers I serve.
